Alternative Dispute Resolution

The Lum Firm provides alternative dispute resolution services to clients in throughout New Jersey as well as New York. Our alternative dispute resolution services include arbitration, mediation, and discovery master appointments of New Jersey Superior Court cases, cases pending in the USDC for the District of New Jersey and other jurisdictions.

Mediation
Mediation is a process in which an impartial third-party facilitates negotiations between the litigants. The goal of mediation is to help them reach a mutually acceptable settlement. The mediator does not make the decision that determines the outcome of the case. Rather, the parties - with the assistance of their attorneys - work with a mediator toward a solution with which they are comfortable.

Many of our attorneys are Court-Approved Mediators certified by the State of New Jersey, Office of Dispute Settlement. As mediation attorneys, we handle a variety of cases assigned by the courts and boast high settlement rates.

Mediation is often used to amicably resolve disputes between parties that have an ongoing business or personal relationship or have had a significant past relationships, where communication problems exist between the parties, but where the principal barriers to settlement are personal or emotional. Certain types of cases, which are particularly well suited to mediation, include commercial disputes, labor & employment matters, construction litigation disputes, product liability matters, environmental matters, certain general equity and probate cases, and divorce proceedings.

Arbitration
In contrast, arbitration is a process by which a neutral third-party or panel considers evidence presented by the parties and makes a decision which may be binding or non-binding, according to statute, rule, or the prior agreement of the parties.

Arbitration and mediation are useful in different situations. Arbitration is often successful in resolving commercial disputes and personal injury matters, as well as in negotiating labor & employment disagreements.

Our New Jersey alternative dispute resolution lawyers have extensive experience representing clients in mediation and arbitration proceedings. We are often sought after to act as the independent arbitrator in matters being handled by other New Jersey firms.

Whatever type of alternative dispute resolution process is involved, our attorneys can advise clients regarding the drafting of appropriate dispute resolution clauses, selection of neutrals, as well as presentation of the case, achieving cost effective and satisfactory results.

If you are a business or an individual in need of the assistance from a New Jersey alternative dispute resolution attorney, contact the Lum Firm. Let our 145 years of experience work for you.
